General terms and booking conditions of Tour-Explorer

The arrangements on this portal have been put together by schierle TOUR-EXPLORER, formerly bike-explorer, based in Parpan / Switzerland. schierle TOUR-EXPLORER is now responsible for arranging and booking the services.
The entire booking process, invoicing and provision of services will be handled by schierle TOUR-EXPLORER.

General terms and conditions of contract and travel

Subject matter of the contract

1. conclusion of contract
After receipt of your registration (online, telephone, letter or fax) you will receive a booking confirmation by e-mail or post. This constitutes the contract between you and TOUR-EXPLORER. With your registration you are obligated to assume responsibility for the contractual obligations of the additional persons you have registered.

With your request / registration you confirm that you have taken note of the present terms and conditions of TOUR-EXPLORER and that you agree with them.

2. prices / price changes
In general, the prices published online by us apply. In the event of a subsequent change to the travel price or a change to an essential travel service, we will inform you immediately, but no later than 21 days before departure. In the event of price increases of more than 10% or in the event of a significant change to an essential travel service, you are entitled to withdraw from the travel contract without incurring any fees. You must assert these rights no later than 10 days after the declaration of the price increase or change. In this case, TOUR-EXPLORER will refund all payments already made by you within 30 days. Otherwise, any price increases or tour changes will be deemed to have been accepted.
Certain tours can be booked for a minimum of 2 people (see booking information). Individuals can also book the tour, but will incur a surcharge.

3. program changes, cancellation of services during the trip, force majeure, unforeseeable or unavoidable events
If a program change is made or cancelled before or during the trip (e.g. due to weather conditions, unforeseeable or unavoidable events, force majeure (e.g. natural disasters, epidemics, unrest) or official measures), which affects a significant part of the agreed trip, TOUR-EXPLORER will reimburse you for any difference between the agreed travel price and that of the services provided. The same applies if TOUR-EXPLORER has to exclude a participant from the onward journey due to excessive demands (guided).

4. registration deadline
For "Self-guided tours with luggage transportation":
The following processing fees will be charged for bookings made at short notice:
2/3/4-day tour CHF 60.-; 5/6-day tour: CHF 80.-; and for a 7 and more day tour CHF 90.-.
- Booking period: May / June / September / October: Bookings made up to 4 working days* before the start of the tour, after which processing fees will be charged (see rates above).
- Booking period: July / August: bookings up to 7 days before departure*, after which processing fees will be charged (see rates above)
- For bookings made 4 or 7 working days before the start of the tour: payment is only possible by credit card or Twint (see 7.1).

5. rebooking
If an existing reservation is changed or rebooked, a rebooking or processing fee of CHF 60.00 will be charged.
If a change or rebooking is made during the trip, a flat-rate rebooking or processing fee of CHF 120.00 will be charged, plus any costs incurred.

6. consultation fees for individual tours
A fee of CHF 100 per consultation, limited to 1 hour, is charged for individual tour consultations.
The consultation fee must be paid before the tour is worked out in detail (hotel and route), irrespective of whether the tour is booked and carried out.
The fees will be credited when a booking is made.

7. terms of payment
You will receive the invoice for your arrangement with the booking confirmation. Your deposit of 20% of the total amount is due within 10 days. The remaining 80% is due 60 days before departure. If you do not receive the invoice until 60 days before the start of the event, payment is due within 10 days.
If the payment deadline is not met, processing fees will be charged in accordance with Section 9 (Cancellation by the customer).

With the confirmation of room availability you will receive the invoice by e-mail as a PDF. Your deposit of 20% of the total amount is due within 10 days. The remaining 80% is due 60 days before departure. If you only receive the invoice within the 60 days before the start of the trip, your full payment is due within 10 days. If the deposit/payment is not received on time, the room reservation will be canceled and processing fees will be charged in accordance with section 8. In the event of a new booking, room availability must be checked again, which may result in changes to prices or services. The method of payment can be selected at the time of booking; for bookings made at short notice (see point 4.2), payment by credit card or Twint is mandatory. The travel documents will be handed over or delivered at the latest 10 days before departure or within a reasonable period in the case of short-term bookings.

8 Liability
TOUR-EXPLORER is liable for the proper fulfillment of the travel arrangement. We will compensate you for the loss of agreed services or your additional expenses if it was not possible for TOUR-EXPLORER to offer you an equivalent replacement service. However, the amount of compensation is limited to twice the price you paid for the travel arrangement. TOUR-EXPLORER is not liable for changes in the travel program due to force majeure, official measures, delays by third parties for which TOUR-EXPLORER is not responsible, and your omissions. TOUR-EXPLORER's liability for damage to property and financial loss resulting from non-performance or improper performance of the contract is limited to a maximum of twice the tour price, unless the damage was caused intentionally or by gross negligence. Lower liability limits or exclusions of liability in national laws remain reserved. TOUR-EXPLORER accepts no liability for the loss of personal effects, valuables, cash, jewelry, photo and video equipment, etc.

Hiking / trail running is naturally associated with increased risk. You practise your sport at your own risk. TOUR-EXPLORER accepts no liability for any resulting accidents and/or physical damage.Our recommendation: Always adjust the speed of your bike or your equipment during the tour to the external conditions (weather, topography, road/trail conditions) and your ability.Helmets and gloves are generally compulsory on TOUR-EXPLORER mountain bike and racing bike tours.

9 Cancellation by the customer
Cancellation of the registration must be sent by registered mail to TOUR-EXPLORER.
In the event of cancellation, we will charge the following processing fees:
If the cancellation is made >>
>> up to 30 days before the start of the trip = CHF 150.
>> from 29 days before departure = 30% of the total price
>> from 21 days before departure = 50% of the total price
>> from 14 days before departure = 75% of the total price
>> from 7 days before the start of the trip or during the trip = 100% of the total price

The difference between the payments you have already made and these fees will be refunded to you. The date on which we receive your cancellation is decisive for the calculation of cancellation costs.

We strongly recommend that you take out travel cancellation insurance.
You have the option of taking out travel cancellation insurance with our insurance partner when you register. The insurance pays the expenses if, for example, someone has to cancel the trip due to illness. Please note: The insurance policy must be taken out no later than 8 days after the final travel confirmation has been issued.

10 insurances
Insurances such as accident, illness, theft, liability etc. are the responsibility of each individual participant. Check your insurance policies for services abroad, as well as for comprehensive insurance cover in the event of accident and illness, including (mountain) rescue costs. Mountain biking / hiking / trail running / racing bikes are naturally associated with an increased risk. Each participant is therefore expected to take a high degree of personal responsibility. Participation is therefore at the participant's own risk.

11 statute of limitations
Claims for damages against TOUR-EXPLORER, regardless of the reason, expire within one year. The limitation period begins on the day following the end of the booked travel arrangement.

12 Passport, visa, customs, foreign exchange and health regulations
You are responsible for the valid documents required for border crossings, such as passport, identity card, etc. If we transport your luggage across a border, it may only contain goods in accordance with the relevant national regulations. If you have to break off the trip for one of these reasons or are unable to start it, this will be treated as a withdrawal from the trip.

13 Luggage transportation
Luggage is transported by public transportation, by a private person or by a distribution partner. We would like to point out that luggage is not insured.

14 place of jurisdiction
The place of jurisdiction is CH-7076 Parpan GR. Swiss law applies.
